Mediation
Mediation is a process where a neutral mediator works with two parties and often their attorneys to create their own resolution to disagreements. Mediation can occur with two parties in the same room or in a caucus with two parties in separate room but negotiating with a mediator. The process at CCMS is as follows:
1) Ground rules are established
2) Issues are determined
3) Solutions that both parties can live with are explored
4) If partial or full agreements are reached, these are documented and sent to an attorney or attorneys (if needed) to create any needed documents.
Only the agreements themselves are disclosed and all participants in the mediation are required to hold all aspects of the mediation and the discussions that occur as confidential.
The majority of people who are considered the winner in a judicial situation are not satisifed with the resolutions the court orders. CCMS provides an opportunity for the involved parties to retain control of the outcomes and discover creative solutions that they can live with.
Family mediation can also provide an opportunity for parties to learn new ways of cooperation and an environment where parents can decide together what is in the best interest of their child(ren). Families are sometimes surprised when the process brings a touch of healing to good people experiencing one of the worst times of their lives.
